Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the NERD - Academic Partner application ("NERD", "the App", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Description of Service

NERD is a peer-to-peer academic tutoring marketplace that connects students seeking academic help with tutors who can provide it. NERD is a platform, not a tutoring service. We facilitate connections between tutors and students but do not provide tutoring services directly.

The Service enables users to:

• Create profiles as students, tutors, or both.
• Search for and connect with tutors by subject, course, or major.
• Book one-on-one and group tutoring sessions.
• Process payments for tutoring sessions.
• Leave ratings and reviews.
• Browse and respond to help requests from other students.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. Users between 13 and 18 years of age should have parental or guardian consent to use the Service.

The Service is primarily intended for university students and K-12 teachers in Jordan.

4. User Accounts

• You must provide accurate, complete, and current information when creating your account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Tutor Responsibilities

If you offer tutoring services through the platform:

• You represent that you have the knowledge and qualifications to tutor in the subjects you offer.
• You are responsible for the quality of your tutoring sessions.
• You must honor confirmed bookings or cancel within a reasonable time.
• You are an independent service provider, not an employee or agent of NERD.
• You are responsible for any applicable tax obligations on your tutoring income.

6. Student Responsibilities

If you use the platform to find tutoring:

• You must attend or cancel booked sessions in accordance with the cancellation policy.
• You must make timely payments for completed sessions.
• You must treat tutors with respect and professionalism.

7. Payments and Commission

• Payment for tutoring sessions is facilitated through the platform.
• Supported payment methods include CliQ and bank transfers as available in Jordan.
• Commission: NERD charges a service fee (commission) as a percentage of each tutoring session payment. The applicable commission rate will be clearly displayed before you confirm a booking.
• Tutors receive the session fee minus the platform commission.
• Payment processing and disbursement timelines will be communicated within the app.

8. Payment Disputes

In the event of a payment dispute:

1. Contact the other party directly through the app to attempt resolution.
2. If the dispute cannot be resolved directly, submit a dispute request through the app or by emailing mohdhasn212@gmail.com.
3. NERD will review the dispute, which may include examining session records, messages, and other relevant information.
4. NERD will make a determination within 14 business days of receiving the dispute.
5. NERD's decision on disputes is final and binding.

9. Prohibited Conduct

You agree NOT to use the Service to:

• Promote academic dishonesty: Providing or requesting services that involve cheating, plagiarism, completing assignments on behalf of others, or any form of academic fraud.
• Share inappropriate content: Posting or sharing obscene, offensive, threatening, or illegal content.
• Harass other users: Engaging in bullying, harassment, discrimination, or any behavior that creates a hostile environment.
• Misrepresent yourself: Providing false qualifications, fake reviews, or impersonating another person.
• Circumvent the platform: Arranging payments or sessions outside of NERD to avoid platform fees after initially connecting through the Service.
• Spam or solicit: Sending unsolicited messages, advertisements, or promotional materials.
• Interfere with the Service: Attempting to hack, reverse-engineer, or disrupt the platform or its infrastructure.
• Violate laws: Using the Service for any purpose that violates applicable local, national, or international laws.

10. Account Suspension and Termination

NERD reserves the right to suspend or permanently ban user accounts that:

• Violate these Terms of Service.
• Engage in prohibited conduct as described above.
• Receive multiple verified complaints from other users.
• Engage in fraudulent activity.

We will make reasonable efforts to notify you before or at the time of suspension, unless doing so would compromise safety or an investigation. You may appeal a suspension by contacting mohdhasn212@gmail.com.

11. Intellectual Property

The NERD app, including its design, code, logos, and content (excluding user-generated content), is the intellectual property of NERD and is protected by copyright and trademark laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.

12. User-Generated Content

By posting content on the platform (including reviews, profile information, and messages), you grant NERD a non-exclusive, royalty-free license to use, display, and distribute such content as necessary to operate and improve the Service. You retain ownership of your content and may delete it at any time.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. NERD DOES NOT WARRANT THAT:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained from the use of the Service will be accurate or reliable.
• Any tutoring provided through the platform will meet your expectations or requirements.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• NERD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
• NERD shall not be liable for the quality, accuracy, or outcomes of any tutoring sessions arranged through the platform.
• NERD shall not be liable for any disputes between users, including payment disputes between tutors and students.
• NERD's total liability to you for any claims arising from the use of the Service shall not exceed the total amount of fees you have paid to NERD in the 12 months preceding the claim.

15. Indemnification

You agree to indemnify and hold harmless NERD, its officers, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Hashemite Kingdom of Jordan. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of Amman, Jordan.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.
